Terms of Service
1. Scope and Validity
Welcome to the Terms of Service (“TOS”) of Ouraca Inc. (“Aibrary”, “we”, “our”, or “us”). These TOS govern your access to and use of the Aibrary platform and related services. Please read them carefully before using our services.
By registering for an account, purchasing a subscription, or accessing any content, you agree to be bound by these TOS. If you subscribe for a fixed term (the “Initial Term”), your subscription will automatically renew for the same duration unless canceled in accordance with these TOS.
2. The Company
Ouraca Inc.
Registered in Delaware, United States
Email: privacy@aibrary.ai
Ouraca Inc. operates “Aibrary”, a digital platform providing mobile reading, listening, and learning services via websites and mobile applications. Aibrary curates and summarizes books and related content into concise formats, enabling users to discover, learn, and organize insights. Users may also purchase or download individual content into their personal Aibrary library.
These TOS, together with the specific terms presented during registration, subscription purchase, or individual content order, form the complete agreement between you and Aibrary. Conflicting or supplemental terms do not apply unless expressly accepted in writing by Aibrary.
3. Services and Rights
Aibrary provides access to summarized or curated insights from books, articles, and other content (“Platform Content”), along with features such as personal profiles, saved items, and curated lists. The scope of available services depends on your account type:
- Free accounts
- Paid subscriptions (various plans)
- Free trials
- Individual content purchases
Content licensed under a subscription is available only during the subscription term. Individually purchased content remains accessible indefinitely, subject to applicable conditions.
All rights to Aibrary’s services, software, and Platform Content remain with Aibrary or its licensors. Content is protected by copyright and may be used only for personal, non-commercial purposes. Redistribution, modification, or exploitation is prohibited.
All Aibrary trademarks, trade names, logos, and other brand features remain our exclusive property. Nothing in these TOS grants you the right to use them.
4. Registration
Registration is required to use Aibrary. You must be at least 18 years old to register. Minors aged 14 or older may register with parental or legal guardian consent. Proof of age or consent may be requested.
Aibrary is not intended for children under the age of 14, and we do not knowingly collect personal data from children under this age.
Registration is free and does not obligate you to purchase a subscription. If your employer provides access, registration through their designated method grants access to the agreed content.
You may register with an email and password or through approved third-party authentication services. You are responsible for providing accurate, up-to-date information and maintaining the confidentiality of your login credentials. Accounts are personal and non-transferable. Any unauthorized use must be reported immediately.
5. Paid Subscriptions
After registering, you may purchase a subscription (“Subscription Access”) for access to premium features and Platform Content. Subscriptions are offered for different terms and are specified during checkout.
Subscriptions may be purchased:
- Directly on Aibrary’s website (confirmation via email)
- Through the mobile app (confirmation via app store receipt)
Subscriptions begin on the date of confirmation. Access remains valid for the duration of the active subscription. In-app purchases are subject to the terms of Apple App Store or Google Play Store.
6. Free Trials
From time to time, Aibrary may offer free trial subscriptions (“Trials”). Eligibility and availability are at Aibrary’s discretion. Unless otherwise stated, the standard trial period is 7 days. Trials may require entering payment details and will automatically convert to paid subscriptions unless canceled before the trial ends. You will be clearly informed before beginning a Trial.
If you do not wish to continue, you must cancel before the 7-day trial period expires.
7. Individual Content Purchases
Users may purchase individual Platform Content without a subscription. Upon purchase, Aibrary grants a personal, non-exclusive, non-transferable license to download and store the content in your Aibrary Library. Modification, resale, distribution, or public performance is prohibited.
8. Cancellation and Withdrawal Rights
8.1 Right of Withdrawal
Consumers purchasing Aibrary services for personal use may withdraw from the contract without providing a reason.
- For users in the United States and other regions without statutory consumer protection rules, Aibrary provides a 7-day money-back guarantee from the date of purchase or trial conversion.
- For users in the European Union or other jurisdictions with mandatory consumer protection laws, you have a 14-day statutory right of withdrawal in accordance with applicable law.
8.2 Exercising Withdrawal
To withdraw, notify us by email or letter before the applicable withdrawal period ends.
8.3 Effects
We will refund all payments within a reasonable period, no later than 14 days after receiving your withdrawal notice, using the same payment method unless otherwise agreed. Actual receipt of funds may depend on your bank or payment provider’s processing times.
8.4 Exceptions
The right of withdrawal expires if:
- You expressly consent to immediate access to digital content and acknowledge the loss of withdrawal rights, or
- Aibrary fully provides the service before the withdrawal period ends.
If you cancel after partial performance, you may owe Aibrary compensation for services provided.
Nothing in these Terms limits your statutory rights as a consumer under applicable law.
(A statutory sample withdrawal form is provided in Section 8.4.)
9. Payments and Refunds
Subscription fees are due at the start of each term or after a trial ends. Discounts apply only to the initial term unless otherwise specified. Accepted payment methods are displayed during checkout, including Aibrary Gift Cards. In-app payments are processed via Apple or Google.
- App Store / Google Play purchases: Refunds are governed solely by the policies of the relevant app store. Aibrary does not process these refunds directly.
- Website purchases: Refunds are available under Aibrary’s 7-day money-back guarantee (or longer where required by law, e.g., 14 days in the EU). Refunds will be processed within 7–14 business days to the original payment method, although actual receipt of funds may depend on your bank or payment provider.
Offsetting or withholding payments is permitted only if legally recognized or directly related to the same contract.
10. Third-Party Content
Aibrary may include links to third-party websites, services, or advertisements. We are not responsible for third-party content or transactions. Your use of third-party services is subject to their terms and policies.
Promotional or sponsored content may be displayed within Aibrary.
11. Term and Termination
- Free Accounts: Continue indefinitely until canceled by you or Aibrary.
- Paid Subscriptions: Renew automatically unless canceled at least 24 hours before the renewal date. Cancellation takes effect at the end of the current term.
Users may delete their accounts permanently via account settings. Aibrary may suspend or terminate accounts for cause, including misuse or violation of these TOS.
12. Gift Cards and Promotions
Gift cards grant access for the specified period and must be redeemed in an Aibrary account. They cannot be exchanged for cash, refunded, or transferred. Once the designated period ends, access reverts to a free account unless you purchase a new plan.
13. Liability
Aibrary is liable only for damages resulting from:
- Death, personal injury, or health impairment;
- Breach of essential contractual obligations;
- Intentional misconduct or gross negligence.
For negligent breaches of essential obligations, liability is limited to foreseeable damages. These limitations also apply to our affiliates, employees, and representatives.
14. Privacy
We process personal data in accordance with applicable data protection laws. Please refer to our Privacy Policy for details.
15. Changes to Terms
We may update these TOS when reasonably necessary. Material changes will be communicated via email or prominent notice in the platform at least 30 days prior to taking effect, unless immediate changes are required by law. Continued use of the service constitutes acceptance.
16. Governing Law and Jurisdiction
These TOS are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware, unless mandatory consumer protection law requires otherwise.
17. Miscellaneous
If any provision of these TOS is held invalid, the remaining provisions remain in effect. Applicable statutory law shall replace invalid provisions.
